Damaged or destroyed luggage

If you discover any damages or missing items of your luggage, you should immediately refer to the Luggage Reclamation Desk or “Lost & Found” office, which serves the airline you have arrived with. You can contact the airline directly, but not later than 7 days from the date of your journey.

When am I eligible for compensation for damaged or destroyed luggage?

You are entitled to compensation only if the event that caused the damage or destruction occurred on board the aircraft or during any time the airline was responsible for the checked baggage.
You would not be entitled to compensation if and to the extent that the damage occurred due to inherent defect, quality or vice of the baggage. If the damage is caused by you or you have contributed to it by your negligence, the airline shall refuse to pay compensation.
In the case of missing items that were contained in the luggage, the air carrier is liable only if the passenger has declared their value, at the time when the luggage was accepted for carrying, and the passenger has paid an amount corresponding to the value of the missing items.

The basic rule is as follows: The liability of the carrier in the case of destruction, loss, damage or delay is limited to 1 202.09 EUR UNLESS the passenger has made, at the time when the checked baggage was handed over to the carrier, a special declaration of interest in delivery at destination and has paid a supplementary sum. In that case the carrier will be liable to pay a sum not exceeding the declared sum, unless it proves that the sum is greater than the passenger’s actual interest in delivery at destination.
